1. Definitions

In these terms and conditions, the following terms have the following meanings:

NanoFishFood.com: Nano Fish Food, based in the Netherlands, registered with the Chamber of Commerce
Customer: The natural person or legal entity entering into an agreement with NanoFishFood.com
Consumer: The customer acting for purposes outside their business or professional activities
Products: All nano fish food products and related items offered by NanoFishFood.com
Website: www.nanofishfood.com
Agreement: Any arrangement between NanoFishFood.com and the customer

2. Applicability

2.1. These terms and conditions apply to all offers, orders, and agreements between NanoFishFood.com and the customer.

2.2. By placing an order, the customer declares to be familiar with and agrees to these terms and conditions.

2.3. Deviations from these terms are only valid if explicitly agreed upon in writing.

2.4. Additional terms may apply to business (B2B) customers, which will be agreed upon in writing.

3. Offers and Formation of Agreement

3.1. All offers on the website are non-binding and subject to availability.

3.2. NanoFishFood.com reserves the right to change prices. Price changes do not affect orders already placed.

3.3. The agreement is formed when NanoFishFood.com confirms the order by email.

3.4. NanoFishFood.com reserves the right to refuse or cancel orders for valid reasons (e.g., suspected fraud or incorrect information).

4. Prices and Payment

4.1. All prices on the website are in euros and include VAT, unless stated otherwise.

4.2. Shipping costs are listed separately and are not included in the product price, unless explicitly stated.

4.3. Payment must be made using the payment methods offered on the website.

4.4. In case of late payment, the customer is automatically in default and NanoFishFood.com is entitled to charge statutory interest.

4.5. Different payment terms may apply to business customers as described in the B2B agreement.

5. Delivery and Shipping

5.1. NanoFishFood.com aims to ship orders within 1-2 business days after receipt of payment.

5.2. Delivery time is 2-5 business days after shipping, depending on the destination and the shipping method chosen by the customer.

5.3. The risk of loss or damage transfers to the customer at the time of delivery.

5.4. In case of delivery delays, NanoFishFood.com will inform the customer.

5.5. If delivery is not possible due to errors in the information provided by the customer, any additional shipping costs will be borne by the customer.

5.6. Deliveries are made to the address provided by the customer. The customer is responsible for the accuracy of this address.

6. Right of Withdrawal (consumers only)

6.1. Consumers have the right to cancel the agreement within 14 days after receipt of the product without stating a reason.

6.2. The right of withdrawal expires if:

• The seal of the product has been broken and the product has been opened
• The product is perishable or has a limited shelf life
• The product is custom-made or clearly personal in nature

6.3. To exercise the right of withdrawal, the customer must notify NanoFishFood.com in writing (by email) within the withdrawal period.

6.4. The customer must return the product postage paid and in original condition within 14 days after notification of withdrawal.

6.5. Return costs are borne by the customer, unless NanoFishFood.com agrees to contribute.

6.6. After receipt and approval of the returned product, NanoFishFood.com will refund the paid amount within 14 days.

7. Warranty and Complaints

7.1. NanoFishFood.com guarantees that the products meet the specifications as stated on the website and are free from manufacturing defects.

7.2. Complaints about delivered products must be reported in writing to NanoFishFood.com within 7 days after receipt.

7.3. In case of justified complaints about product defects, NanoFishFood.com will replace the product or refund the purchase amount.

7.4. The warranty expires if:

• The product has not been used in accordance with the instructions for use
• The product has been exposed to improper storage (moisture, extreme temperatures)
• The expiration date has passed

7.5. NanoFishFood.com is not liable for damage resulting from improper use of the products or damage to fish as a result of factors other than the food itself.

8. Liability

8.1. NanoFishFood.com is only liable for direct damage resulting from an attributable shortcoming.

8.2. The liability of NanoFishFood.com is limited to the amount of the relevant order, with a maximum of €500.

8.3. NanoFishFood.com is not liable for indirect damage, consequential damage, loss of profit, or damage to fish.

8.4. NanoFishFood.com advises customers to always introduce food gradually and observe the fish when using new food.

9. Intellectual Property

9.1. All intellectual property rights relating to the website, products, texts, images, and formulations belong to NanoFishFood.com.

9.2. It is not permitted to reproduce or publish any part of the website or product information without prior written permission from NanoFishFood.com.

10. Privacy and Data Protection

10.1. NanoFishFood.com handles customer personal data carefully in accordance with GDPR legislation.

11. Disputes

11.1. Dutch law applies to all agreements between NanoFishFood.com and the customer.

12. Changes

12.1. NanoFishFood.com reserves the right to change these terms and conditions.

13. Final Provisions

13.1. If one or more provisions of these terms and conditions are void or are annulled, the remaining provisions remain in force.

13.2. In case of conflict between the Dutch and any translated version of these terms, the Dutch version prevails.
